NAGAR

Writ Petition 1152 of 2002, originally filed by NAGAR (then CitiSpace) in 2002, challenged the development of slum-occupied plots reserved as public open spaces under the SRA scheme. The judgment was pronounced on 19 June 2025. While the Bombay High Court declined to strike down Regulation 17(3)(D)(2) of the DCPR 2034, it acknowledged the critical public concerns raised by NAGAR’s 23-year-long legal battle (WP 1152 of 2002) to safeguard Mumbai’s public open spaces. The Court invoked Article 226 to issue 17 directions protecting public open spaces, environmental rights, and ensuring accountability in Slum Rehabilitation Schemes.

This is a step forward – one that holds the State accountable for how Mumbai’s open spaces are planned, protected, and shared.
